Labour Court recommends Canada Life pay former worker for business won before he left

The Labour Court recommended that Canada Life Assurance Company pay a former employee an amount to be agreed for earnings on business won up to his termination. It also suggested the company review its career contract to remove wording likely to mislead employees. The recommendation was signed on 14 June 1991. The worker claimed commission earnings from June 1989. Canada Life said his contract excluded commission payable after he left and that all commissions due had been paid. The Court considered that the contract supported a reasonable expectation that he would benefit from business won before his departure. It said his personal account should be taken into account when calculating any outstanding earnings. The worker had agreed to be bound by the Court’s recommendation.
