The Labour Court recommended that the Services Industrial Professional Technical Union accept Midland International Limited’s use of outside hauliers for six months, followed by a review. The recommendation was signed on 19 December 1990. The Court found staff had not been sufficiently consulted before the company decided to use contractors. Midland International said increased deliveries were needed and contracting was more cost-effective than hiring another driver and buying a van. The union argued that the spare driver could handle the extra runs and objected that the contractor employed non-union labour.
