In 1990, the Labour Court recommended that Babygro Limited pay a salesman with 40 years’ service 2.5 weeks’ pay for each year of service, in addition to his statutory entitlements. The recommendation was signed on 25 October 1990. Babygro had offered statutory entitlements and two weeks’ pay ex gratia, saying substantial losses prevented it from paying more. The Sales Marketing And Administrative Union Of Ireland sought £30,000 plus statutory entitlements, citing the salesman’s long service, lack of a company pension and limited prospects of other work. The Court considered his service, the absence of a pension and the business rationalisation when recommending the enhanced formula.
