Labour Court rejects union claim for time off in lieu at Analog Devices

In 1990, the Labour Court recommended that Analog Devices B.V. not concede the Services Industrial Professional Technical Union’s claim for time off in lieu for 11 part-time evening-shift workers. The recommendation was dated 15 October 1990. The union sought half the time off granted to full-time workers, offering to have the workers make up half an hour each week. It said the earlier shift start had caused difficulties with childcare and school arrangements. The company argued that the working-hours reduction applied only to full-time staff and that the extra hours were not operationally required. The Court found the workers did not qualify for reduced hours or time off in lieu under the Programme for National Recovery, and that making up the time was not operationally feasible.
