In 1990, the Labour Court recommended that Aer Lingus not exclude an amount equivalent to the dual-function payment from scales under discussion for supervisory chefs. The recommendation was signed on 9 April 1990.
Services Industrial Professional Technical Union sought to restore pay parity between supervisory chefs and technical supervisors. A £750 annual payment for technical supervisors had been incorporated into restructured scales. The union argued that the change meant the payment was no longer peculiar to technical supervisors; the company said the revised scales reflected changes specific to that group.
The Court considered that incorporating the payment into the restructured scales had changed its nature. It recommended that an equivalent amount not be excluded from the scales being discussed between the parties.
