Labour Court declines to recommend reinstatement of British Midland ramp worker

In 1990, the Labour Court recommended against reinstating a British Midland Limited ramp worker dismissed on health grounds. The recommendation was signed on 31 January 1990. The worker argued that his driving accidents were not caused by his eyesight and relied on an ophthalmologist’s assessment that he was fit for airport driving. British Midland Limited said an occupational health specialist advised against airside driving and that the worker did not meet the requirements for the limited alternative posts. The Court accepted that the company acted reasonably and found no grounds to recommend reinstatement.
