The Labour Court found that a driver had been unfairly dismissed by John Cullen And Sons Limited and recommended that the company re-employ him or pay £750 compensation. The recommendation was signed on 7 November 1989. The Irish Transport And General Workers' Union brought the claim after the driver was made redundant while a less senior driver was kept on. The company said the other driver was better suited to the remaining work. It was in receivership and said it could not re-employ him.
