The Labour Court recommended that a shift premium should not apply to a Bus Eireann driver whose weekly roster did not rotate or alternate. The recommendation was signed on 21 July 1989. The Irish Transport And General Workers' Union argued that the driver's varying start times qualified for the premium. Bus Eireann said he worked the same weekly roster, with a maximum difference of 1 hour 35 minutes between start times. The Court found the difference did not qualify for the premium paid for alternating shifts from Monday to Saturday.
