Labour Court recommends bonus and salary-scale treatment for two Upright workers

The Labour Court recommended bonus payments and salary-scale treatment for two workers re-employed by Upright Limited. Its recommendation was signed on 26 April 1988. Upright said the workers had been made redundant before being re-employed, ending continuity of service. The National Engineering And Electrical Trade Union argued that their time away had been temporary layoffs. The Court said the company was theoretically correct, but considered another probation period inequitable given the short breaks. It recommended bonus payments for Worker A for the quarter ending 31 September 1986 and Worker B for the quarter ending 31 December 1986, and placing both at the starting point of the salary scale from the start of their second employment. It also recommended clarifying the agreement for similar future cases.
