In 1988, the Labour Court recommended that Fulflex International Limited re-employ a worker it had dismissed after an assault at a company social function. The recommendation was signed on 21 April 1988. The Court found the claimant's behaviour was work-related and serious enough to warrant dismissal, but said the incident would not have happened had he not consumed so much at the company-sponsored function. It recommended treating the period to 30 April 1988 as unpaid suspension, then re-employing him on probation with conditions on his behaviour. The Irish Transport And General Workers' Union had sought reinstatement, citing the worker's service record and apology. The Court also recommended that management address the workplace atmosphere and require employees to behave reasonably towards one another.
