In 1988, the Labour Court recommended that Bus Atha Cliath pay the non-participation bonus from 1 January 1988 to claimants who had formerly been driving and conducting staff. The claim was advanced for approximately 41 rehabilitated staff. The National Busworkers' Union and I.C.T.U. Road Passenger Group argued that the staff had lost earnings and bonuses after moving to rehabilitated roles; management said the allowance was for non-participating bus crews and staff knew the terms of their new jobs. The Court referred to its 1981 policy and the nature of the payment. The recommendation was signed on 14 April 1988.
