In 1988, the Labour Court recommended that Artane Service Station Limited compensate a worker under an agreement covering the change from direct operation of service stations to agency operation. The decision was signed on 7 April 1988. The Irish Transport And General Workers' Union argued that the worker remained an employee when the change took place, although she had been off sick and was not on the company payroll. The Court found she was still an employee at the time of the changeover and should receive compensation under the agreement.
