The Labour Court found Cadbury (Ireland) Limited’s interpretation of its lates and absences procedure was correct. The recommendation, signed on 29 January 1988, concerned whether another warning could be issued within six months of an earlier one. The Federated Workers' Union of Ireland and the Amalgamated Transport and General Workers' Union argued that workers should have a full six months before progressing to another warning. Cadbury (Ireland) Limited said the six-month period governed how long a warning remained on a worker’s record, not when another warning could be issued. The Court recommended accordingly.
