WRC recommends changes to transport company’s grievance investigations

The WRC recommended that a transport company review its grievance investigation policy and implement outstanding recommendations after a worker challenged how his complaint was handled. The recommendation was dated 26 August 2024. The worker said his manager grabbed him by the collar. The employer said the manager’s raised hand made contact with the worker’s chest. Adjudication Officer Anne McElduff rejected the employer’s jurisdiction objection and found that the process was largely fair. She said CCTV should have been shared with the worker during the investigation, although she was not persuaded the delay significantly disadvantaged him. She also recommended exhausting efforts to interview relevant or named witnesses. McElduff made no recommendation on the worker’s proposed compensation.
