The Workplace Relations Commission recommended that a policing service pay a worker €15,000 compensation over its handling of her illness classification and workplace grievances. Adjudication Officer Ewa Sobanska dated the recommendation 25 October 2024.

The worker raised concerns about a transfer, workplace accommodations and the handling of her application for Code 11.37 status. The employer said it had corrected a transfer error and offered full pay for the period from 22 September 2020 to 24 September 2021, but the worker rejected the offer.

Sobanska found serious shortcomings in the grievance investigation, which did not address all the issues raised or give the worker a chance to review the report. She also found problems with processing the Code 11.37 application, including delays and an unresolved appeal process.

The recommendation says the employer should treat the period from 22 September 2020 to 24 September 2021 as qualifying for full pay, reconsider the Code 11.37 application and investigate the accommodation and treatment grievances. It also recommends that the employer engage with the worker and the Chief Medical Officer about supporting her return to work.
