The WRC recommended that a health care service provider pay a worker €16,000 after finding it handled his review and appeal over an unsuccessful promotion application unfairly. The recommendation was dated 12 May 2023.
The worker believed an offer for a Grade VI HR/payroll compliance manager role was withdrawn because he requested carer’s leave. The employer said it withdrew the offer after an unsatisfactory reference for his temporary Grade VII role, citing concerns about responsibility, caseload management and communication with his supervisor.
The adjudication officer accepted that the employer could rely on the reference, but found it failed to explain that reason clearly or properly address the worker’s concerns during the review and appeal. The officer found the process did not follow proper procedures and recommended €16,000 in compensation, citing about €5,000 in annual financial losses as well as stress and disrespect.
