The Labour Court decided that Vadym Panasenko and the other applicants were covered by the construction industry Registered Employment Agreement (REA), entitling them to its terms and to join the Construction Workers Pension and Sick Pay Scheme or a comparable scheme. The decision was signed on 20 October 2011. B & L Distributors Ltd argued that its stretch-ceiling business fell outside the agreement. The Court found that the company’s principal business included construction, repair or decoration of ceilings in buildings, and that the applicants’ installation work made them construction operatives covered by the REA.
