The Labour Court determined that the Construction Industry Registered Employment Agreement applied to Zbigniew Oblak, Antoi Bemowski, Dariusz Tryala and Krzysztof Kacprzak, workers at Foley Engineering and Construction Limited. The determination was signed on 5 January 2011. The workers argued their construction duties entitled them to Grade A and Grade D rates. The company said its main business was manufacturing metal products and it was in liquidation. The Court found the workers habitually carried out construction-related activities covered by the agreement.
