Labour Court rules construction agreement applies to Statcroft workers

By Aoife Loughran

Labour Court ·

The Labour Court found that Statcroft Transport & Civil Engineering Ltd was a civil engineering firm covered by the Construction Industry Registered Employment Agreement. Its decision was dated 2 December 2010. Statcroft asked the Court to decide whether the agreement applied to the company and its employees. It argued that haulage and transport were its principal activities, with groundwork and excavation ancillary to that work. Nera said Statcroft was a civil engineering firm covered by the agreement. The Court found that construction-related haulage, groundwork and excavation made up a substantial part of the business. It also considered the company’s equipment and the nature of its work in concluding that the agreement applied to workers within its scope.
