The Labour Court found that Permafix Solutions Ltd was a building firm covered by the Construction Industry Registered Employment Agreement (REA), bringing its workers within the agreement. The company argued that its fire-stopping work did not make it a construction firm. Nera contended that the REA applied. The Court found that fireproofing was an integral part of constructing the buildings where it was used. It said workers could be classified as construction operatives or painters, and that disputes about their grading should go through the REA’s dispute procedure. The decision was signed on 19 August 2010.
