The Labour Court found that Portella Developments Limited was a building company covered by the construction Registered Employment Agreement (REA), and that a worker was employed as a general operative under its terms. The worker said he had not received the proper rate of pay or the relevant pension and sick pay scheme benefits. Portella said he was a gardener and was not covered by the agreement. The Court said any dispute about his applicable pay rate should first be dealt with through the agreement’s grievance and dispute procedure. The decision was signed on 11 August 2010.
