The Labour Court decided on 7 January 2010 that the Construction Industry Registered Employment Agreement did not apply to Ballycoolin Contract Services Limited. Two workers, represented by Polish Consultancy Enterprise, had asked whether the agreement covered their work fitting windows and doors on construction sites. The company argued that its principal business was manufacturing, supplying and installing windows and doors, rather than building. The Court found that on-site work made up less than 50% of its business and concluded that it was not a building firm covered by the agreement.
