The Labour Court found De Bros Marble Work Limited was covered by the Construction Industry Registered Employment Agreement in a decision signed on 14 May 2009. It also found that the unnamed worker was a construction operative entitled to the agreement’s rates of pay and employment conditions. The worker had claimed incorrect pay and grading, unpaid overtime and exclusion from the Construction Workers Pension Scheme. The company argued its marble alteration and fitting work did not bring it within the agreement. The Court found that this work made the company a building firm covered by the agreement.
