The Labour Court upheld a decision that Veronica Dowling’s penalisation complaint against An Post was not well founded. The Court’s decision was dated 25 October 2024.

Dowling said An Post penalised her after she raised a health and safety complaint about a workplace incident. She alleged the company restricted her access to CCTV footage, mishandled her grievance and threatened to withdraw her sick pay. An Post said it gave her opportunities to view the footage, followed its grievance procedures and changed her sick pay under her employment terms.

The Court found An Post’s arrangements for viewing the footage were reasonable and that Dowling was not denied access. It found no detriment relating to the CCTV or sick pay during the period covered by her complaint, and no adverse treatment in how the company applied its policies. The Court considered a threat to decide her grievance before the investigation ended detrimental, but found it was made in response to Dowling’s failure to engage with the process, rather than her protected complaint. The Court therefore found no penalisation and upheld the original decision.
