The Labour Court upheld the rejection of Jason Quinn’s complaint against MSR-FSR Ireland Limited, finding no link between his workplace safety complaints and the detriment he suffered. The determination was signed on 16 April 2020.
Quinn, a glass blower, said he was isolated after raising safety concerns and was penalised when he did not receive a performance review. The company said it addressed safety issues and that the missed review was unrelated to his complaints.
The Court accepted that Quinn had raised protected safety concerns and that the missed review was a detriment. It found the review delay applied to staff generally and accepted the supervisor’s explanation for not reviewing Quinn after his return. The Court did not find that his concerns had been ignored or that he had been isolated.
