Labour Court upholds rejection of Robert Brennan’s safety complaint against An Post

The Labour Court has upheld the rejection of postman Robert Brennan’s complaint that An Post penalised him for raising safety concerns. In a determination dated 31 August 2018, it found the complaint was not well founded.

Brennan said a long, narrow packet could not be delivered safely by bicycle. An Post said it was within the permitted dimensions and part of his delivery route. The company issued him a first-level written warning that remained on his file for a year.

The Court found An Post arranged for the packet to be left in a drop-box near the customer’s home, from where Brennan could carry it by hand. It concluded that the remaining refusal concerned his work duties rather than a safety issue protected by the Act, and affirmed the adjudication officer’s decision.
