The Labour Court disallowed Sean Considine’s appeal and affirmed the finding that his penalisation complaint against Limerick City & County Council was not well founded. The determination was signed on 13 June 2016. Considine said disciplinary steps followed an email to Human Resources in which he intended to make a bullying and harassment complaint. The Council said the disciplinary process had begun before the email and was independent of it. The Court found there was no causal link between the protected act and notification of the disciplinary procedure.
