The Labour Court directed Stobart Ireland Driver Services Ltd to pay Keith Carroll €61,633.84 in lost earnings after disallowing the company’s appeal and rejecting its request for a further reduction. The determination was signed on 5 November 2014.

Carroll’s complaint concerned his dismissal after he raised a health and safety issue. A Rights Commissioner had found the complaint well-founded and directed reinstatement with compensation for lost wages. The Labour Court upheld reinstatement and varied how the lost earnings were calculated.

The Court calculated gross lost wages of €71,080.84 over 118 weeks, using average weekly earnings of €602.38, then deducted €9,447. Stobart argued that other money Carroll earned while awaiting the outcome of its High Court appeal should also reduce its liability. The Court rejected that argument and directed payment within six weeks.
