Labour Court rejects worker’s appeal over Sky Handling safety complaint

By Niamh Kearney

Labour Court ·

The Labour Court rejected a worker’s appeal against a finding that Sky Handling Partner Ltd had not penalised her for raising a workplace safety complaint. The decision was signed on 27 June 2012.

The worker said her working conditions worsened after she complained about managers’ conduct and that her later treatment, including her redundancy, was retaliation. Sky Handling Partner Ltd said it had addressed her complaint and made her redundant after losing a major contract.

The Court found the company had dealt with the complaint in December 2009 and found no evidence linking later workplace difficulties or the redundancy to it. It said the company acted reasonably in its medical review and leave arrangements. Although it described errors in shift and holiday pay as inept, it found they did not amount to penalisation. The Court upheld the Rights Commissioner’s decision and disallowed the appeal.
