The Labour Court upheld a €2,500 compensation award to teacher Siobhan McVeigh, finding that the Board of Management, St David's CBS Secondary School Artane penalised her after she requested its bullying and sexual harassment policy. The determination was dated 8 July 2011, after the Board appealed a Rights Commissioner decision in McVeigh's favour.
McVeigh said the Principal moved her to stage two of the disciplinary process after she requested a copy of the policy. The Board argued that the step followed a dispute over exam supervision and was not caused by the request.
The Court found the policy request was protected under the Safety, Health and Welfare at Work Act 2005. It noted no new incident occurred between McVeigh's 4 June letter and the Principal's 8 June response, and concluded that the request prompted the move to stage two, a process that could expose her to sanctions. The Court affirmed the Rights Commissioner's decision, upheld the €2,500 award and disallowed the Board's appeal.
