Labour Court rejects Peggy Waters’s appeal over health and safety penalisation

The Labour Court rejected Peggy Waters’s appeal against Western Care Association, affirming the Rights Commissioner’s finding that her penalisation complaint was not well founded. The determination was dated 19 May 2011.

Waters, a social care leader, said her probation was extended and she was dismissed after raising health and safety concerns. Western Care Association denied that her dismissal was connected to those reports.

The Court found she had not established a link between her reports and the alleged detriment. It found serious differences over her management style were the operative reason for extending her probation and dismissing her.
