Labour Court dismisses worker’s penalisation appeal

By Eimear Byrne

Labour Court ·

The Labour Court dismissed a worker’s appeal over alleged penalisation after she complained of bullying, affirming the Rights Commissioner’s decision. The Court signed its determination on 6 December 2010. The worker argued that a change in her reporting arrangements amounted to a demotion and that disciplinary proceedings were further penalisation. The organisation said her salary, job title and responsibilities were unchanged, and that the disciplinary process followed her refusal to obtain prior approval before external work meetings. The Court found that the reporting change was not a demotion and that the worker’s refusal was the dominant and causal reason for starting the disciplinary process. It disallowed the appeal.
