The Labour Court rejected John Curtis’s appeal, finding that the Citizens Information Board had not penalised him under the Safety, Health and Welfare at Work Act 2005. The determination was signed on 4 February 2010. Curtis said that after a discussion with his manager about inappropriate work, his duties changed and he lost the facility to work flexi-time. The Court found the discussion could not reasonably be understood as a health and safety complaint and that Curtis had not suffered a relevant employment detriment.
