The Labour Court found Philip Kirwan's penalisation complaint against the Department Of Justice Equality & Law Reform not well founded and dismissed it. The determination was signed on 16 January 2008. Kirwan said that after he raised health and safety concerns, changes to protection duties cost him subsistence allowance and reduced his overtime. The Court could not entertain the subsistence aspect because the duty-pattern change predated the Safety, Health and Welfare at Work Act 2005. It found no unfair treatment in overtime allocation, citing operational factors behind the 2005 reduction and higher ordinary overtime hours in 2006 than in 2004.
