Labour Court upholds decision against Catherine Sheehan in fixed-term work appeal

The Labour Court upheld the decision against Catherine Sheehan in her appeal over her acting manager assignment at Cork County Council’s regional training centre in Ballincollig. The determination was dated 19 February 2019. Sheehan sought a contract of indefinite duration and to return to the manager role. The council said she remained a permanent employee and that the acting assignment was temporary. The Court found that her permanent status continued and that an employee cannot be both permanent and fixed-term in the same role. It upheld the adjudication officer’s decision that she could not bring a claim under the Protection of Employees (Fixed-Term Work) Act.
