The Labour Court set aside a decision in Anna Concarr’s favour and found her complaint against the Department of Employment Affairs and Social Protection was not well founded. The determination was dated 18 July 2018.
Concarr had worked for the Department on one specified-purpose contract from October 2012. The Adjudication Officer had found she was entitled to a contract of indefinite duration after more than four years’ service.
The Department argued that the Act’s four-year limit applied to successive contracts, while Concarr had been employed on only one. The Court found that section 9 regulates contract renewals and that, because her contract had not been renewed, the Department had not breached it. It substituted a finding that the complaint was not well founded.
