Labour Court rejects Mark Roache’s appeal over fixed-term contracts

The Labour Court rejected Mark Roache’s appeal against Liebherr Container Cranes Limited, finding that the reasons given for renewing his fixed-term contracts met the statutory requirements. The determination was signed on 19 February 2018. Roache argued that “fluctuation in business demand” was too general to justify renewing the contracts. Liebherr said it had provided written grounds and that the Court could not assess their quality under the claim before it. The Court found the stated reason addressed changing business demand and that successive fixed-term contracts were a proportionate and appropriate way to meet that objective.
