The Labour Court determined that HSE West must pay Carmel Fallon €4,000 and reinstate her on a contract of indefinite duration, following its failure to implement a Rights Commissioner decision. The determination was signed on 16 October 2014.
Fallon’s complaint was made under the Protection of Employees (Fixed-Term Work) Act 2003. The Court directed that her contract take effect from 9 April 2014, in line with the Rights Commissioner decision.
