The Labour Court rejected engineer William Winters's appeal against two findings that his complaints against Wicklow County Council were not well founded. The determination was signed on 21 January 2013. Winters argued that the council failed to notify him of vacancies and ended his fixed-term employment to prevent him qualifying for a contract of indefinite duration. The council said vacancies were notified by email and intranet, and that his employment ended when the project work was finished. For the section 10 complaint, the Court found no evidence of an act within the relevant time period. For the section 13 complaint, it did not accept that he had been assured he could return to the South Quay Project and found his employment ended because the project work was finished. It upheld the Rights Commissioner's decisions and rejected the appeal.
