The Labour Court overturned the Rights Commissioner’s finding against Dr Aziz Ur Rahman and ruled that his contract with HSE South became indefinite on 5 July 2010. The determination was signed on 27 September 2012.
HSE South employed Dr Ur Rahman on successive fixed-term contracts from July 2006. It said the contracts were justified while it filled a permanent consultant vacancy. The Court accepted that reason for his November 2008 contract, but found no objective grounds for the contract issued on 5 July 2010. It required HSE South to acknowledge that contract’s indefinite duration.
