Labour Court affirms ruling on worker’s fixed-term work complaint

By Ruairí Dolan

Labour Court ·

The Labour Court affirmed a Rights Commissioner’s decision that it had no jurisdiction to hear a worker’s fixed-term work complaint under the Protection of Employees (Fixed-Term Work) Act 2003. The determination was signed on 26 July 2012; the merits were not decided. The worker argued that repeated renewals of his Community Employment Scheme contract entitled him to a contract of indefinite duration. The Court found the scheme was a publicly supported training, integration or vocational retraining programme, excluding his contract from the Act. The respondents were City of Dublin Vocational Education Committee, FAS National Training & Employment Authority and Finglas Sports Development Group.
