The Labour Court required HSE South to give Irene Horohan a contract of indefinite duration after finding it had not implemented a Rights Commissioner’s decision. The determination was signed on 18 April 2011. Horohan complained under section 15(8) of the Protection of Employees (Fixed-Term Work) Act, 2003. The Court said her contract hours should reflect her normal weekly hours over the previous 12 months. She was represented by the Services Industrial Professional Technical Union.
