The Labour Court required HSE South to give Tina Tyrell a contract of indefinite duration after finding it had not implemented a Rights Commissioner’s decision. The determination was signed on 18 April 2011. Tyrell complained under section 15(8) of the Protection of Employees (Fixed-Term Work) Act, 2003. Her contract hours must be based on her normal weekly hours in the previous 12 months. She was represented by the Services Industrial Professional Technical Union.
