The Labour Court required HSE South to give Tom McGuinness a contract of indefinite duration after finding it had not implemented a Rights Commissioner’s decision. The determination was signed on 18 April 2011. McGuinness complained under section 15(8) of the Protection of Employees (Fixed-Term Work) Act, 2003. The Court heard the case in Kilkenny on 1 March 2011 and said his contract hours should reflect his normal weekly hours over the previous 12 months. He was represented by the Services Industrial Professional Technical Union.
