The Labour Court required HSE South to give Stephen McDonald a contract of indefinite duration after finding it had not implemented a Rights Commissioner’s decision. The determination was signed on 18 April 2011. McDonald complained under section 15(8) of the Protection of Employees (Fixed-Term Work) Act, 2003. The Court said his contract hours should reflect his normal weekly hours over the previous 12 months.
