The Labour Court determined that Trinity College Dublin must acknowledge Caoimhe Ni Ghormain was employed on a contract of indefinite duration from 9 March 2010. The determination, signed on 4 March 2011, followed the college’s failure to implement an unappealed Rights Commissioner decision. The complaint was brought under section 15(8) of the Protection of Employees (Fixed-Term Work) Act 2003. Ni Ghormain was represented by IFUT. The Court said the Rights Commissioner decision had not been carried out and no appeal had been brought against it within the time limit. It therefore determined that the college acknowledge Ni Ghormain’s employment status, giving effect to the earlier decision. The case concerned implementation of that decision; the Labour Court determination records no monetary award.
