The Labour Court found that Letterkenny Institute of Technology had carried out a Rights Commissioner’s decision in Christopher Hudy’s favour, dated 11 October 2011. Hudy had said he was owed wage arrears for a period when he worked under a contract for services. The institute argued that payments made during that period should be offset against any arrears. The earlier decision required Hudy’s contract to be treated as one of indefinite duration from 1 August 2009, with his employment treated as continuous from that date. The Court said it could not vary that decision to account for either side’s submissions, and found its requirements had been fulfilled.
