The Labour Court required HSE South to issue Sabrina Sexton a contract of indefinite duration, with hours based on her normal weekly hours in the previous 12 months. The determination was signed on 18 April 2011. Sexton complained that HSE South had not implemented a Rights Commissioner decision. The Court found that the decision had not been carried out and directed HSE South to issue the contract in accordance with it. Sexton was represented by the Services Industrial Professional Technical Union.
