The Labour Court allowed Martin Henderson’s appeal and awarded him €2,000 compensation after finding that Scoil Iosagain failed to tell him about six permanent teaching vacancies. The Court’s determination was dated 18 April 2005.
Henderson worked at the Buncrana school as a fixed-term teacher from August 2002 to August 2003. He said he had not been told about the vacancies, which were advertised in a national newspaper. The Court found that newspaper advertising was not enough: vacancies had to be communicated personally to fixed-term staff or announced in the workplace. It also found the school was part of the State’s national school system and that the EU directive on fixed-term work applied. The Court said it could not require the school to notify Henderson about future vacancies because he no longer worked there.
