In 1999, the Labour Court refused to extend the time limit for Johanna Barry’s section 2(a) claim against St James’s Hospital, concerning an alleged incident in 1990. It said reasonable cause had not been shown for the delay before the claim was referred in June 1996; the merits were not decided. Claims under sections 2(b) and (c) were withdrawn. The Court extended the time limit for the section 2(d) claim because Barry had been using in-house procedures, allowing it to proceed to an Equality Officer for investigation. The decision was dated 31 March 1999.
